SWANA against CAA changes


A proposed federal rule that would subject many waste disposal facilities, including landfills, to the Clean Air Act has not met with the approval of the Solid Waste Association of North America (SWANA), which has submitted its comments to the US EPA. The EPA’s proposed new rule would require sites which produce a certain amount of CO2 emissions to obtain permits and show that they are using the ‘best available technologies’ to minimize emissions.

‘If they were to finalize this rulemaking as proposed, they would subject a large number of very small solid waste disposal facilities to regulation under the Clean Air Act,’ said John Skinner, executive director and CEO of SWANA. ‘This would represent a very expensive undertaking for the regulated facilities for a very small reduction in emissions.’

SWANA also feels that WTE operations would be unfairly impacted because they would have to prove ‘best available technology’ regardless of the amount of CO2 emissions avoided by WTE on a life-cycle basis.
